Nowadays artists, art dealers, critics and collectors, both public as private, may not only be concerned with artistic and aesthetic matters but also need to take all legal aspects of their activities into account.
Our Art & Culture practice team assists the various actors in the sector with all legal aspects in this complex environment, covering among others intellectual property, freedom of expression, the resale right (“droit de suite“/”volgrecht“), sales & tax law, estate planning, art forgery, cultural diversity, the protection of tangible or intangible cultural heritage, the tackling of the illicit trafficking and restitution of cultural goods, and specific issues relating to collection societies, collective management and licensing bodies. We also optimise revenues for artistic creators (advising among others on the beneficial tax treatment for copyright and neighbouring rightsholders) and help artists, heirs and collectors set-up Belgian or international foundations for the long-term management and valorisation of artwork portfolio’s and collections.
Our team deals with all contracts related to artworks such as consignment, commission, sales, loans, securities, financing, production, exhibition, licensing and diffusion. We also rely on an extensive network of international partners to offer a multidisciplinary cross-border service .
In this practice team, Jacques Verhaegen is not solely contributing his broad experience in corporate and not-for-profit matters, but also his in-depth knowledge of the Art & Culture sector as a lifelong art enthusiast, collector and director or member of various artistic & cultural institutions, museums and foundations in Belgium.
By bundling Jacques’ strenghts, with the IP practice led by Emmanuel Szafran, we provide our clients with a unique one-stop shop for all national and international Art & Culture related issues.
